Terms & Conditions


Please read these User Conditions carefully before you download, install or use the Happi mobile application (“Happi App”) or access and use the services, tools, forums and applications (“Applications”) on www.happi.sg, www.thehappiapp.com, and www.happiglobal.com (“Site”). By downloading, installing or using any of the Applications, you indicate that you accept these User Conditions and the Site’s Terms of Use and Privacy Policy (which are hereby incorporated by reference into these User Conditions) which automatically takes effect on the date on which you first download the Happi mobile application (“Happi App”) or first use any Applications. In the event of any conflict or ambiguity between these User Conditions and the Site’s General Terms of Use and/or Privacy Policy, these User Conditions shall prevail.

This document covers the terms and conditions for usage of the Happi App and Site in Singapore. Usage of the Happi App and Site in other countries may be governed by separate User Conditions documents as created by Happi’s designated partner in each country. All translated or locally modified User Conditions are agreed between the users in that country and Happi’s designated partner in that country.  We include clauses and terms to satisfy the conditions of many countries in this document, but all of our legal documents are based on and governed by the laws of the Republic of Singapore.

Happi operates through a global network of partners. The designated Happi partner in each country acts with all of the rights and obligations as does Happi in Singapore in their respective countries.

If any of our terms are unacceptable to you, please uninstall Happi.

  1. User Account Registration
  1. In order to register a Happi User account, you must be an individual who is at least 16 years old.  You will be permitted one (1) User account only. You must provide Happi with accurate, complete, and up-to-date profile information. Creation of multiple accounts by the same person is strictly prohibited. Happi reserves the right to disable all duplicate accounts and, in its discretion, temporarily disable or permanently blacklist people who create multiple user accounts. Users with accounts that have been disabled or blacklisted are ineligible to win prizes.

1.1  The registration process requires you to input your date of birth, gender, nationality, place of residence and a picture of yourself holding a picture ID under your chin. This is to verify the accuracy of your registration information. This image and information will be used in the accept or reject assessment made for each registration. The images are deleted automatically after our system administrator clicks on Accept or Reject. If your registration is rejected, you may try again, but this will require a new image to be uploaded.

1.2     As part of the User registration process, you need to register a mobile phone number and email address. You must not select or use another person’s mobile number or email address with intent to impersonate such person or without authorisation. You must not create multiple User accounts. You understand that Users who create multiple accounts may have all of their accounts deactivated and forfeit all accumulated compensation credits.

1.3     Your User account is for your personal use and is not transferable. You are solely responsible for safeguarding and maintaining the confidentiality of your account, and must not permit others to use your User account, or assign or otherwise transfer your User account to any other person. You accept that Happi may use biometric or other technology or process enforced means of ensuring the identity of each survey responder. You must promptly notify Happi of any known or suspected unauthorised use of your User account, or any known or suspected breach of security. You will be bound by and responsible for, and Happi is entitled to rely on, all communications transmitted through your User account. Happi has no responsibility or liability for any loss, damage, cost, expenses, or liabilities arising as a result of or in connection with the wrongful or fraudulent use of your User account.

1.4     The Applications include certain services that are available via a mobile device, including the ability to upload content to them via a mobile device, browse the Applications from a mobile device, and access certain features through an Application downloaded and installed on a mobile device (“Mobile Services”). To the extent you access the Applications through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices. By registering a User account and using the Mobile Services, you agree that Happi may communicate with you by SMS, MMS, e-mail, text message, in-app push notification or other electronic means to your mobile device and that certain information about your usage of the Mobile Services may be communicated to us. If you change or deactivate your mobile telephone number, you agree to promptly update your User account information.

2         Compensation

2.1     Happi provides users an internal currency called Smiles. Users earn Smiles by responding to survey questions, uploading pictures or videos and/or enabling monitoring services as part of the HappiRewards program. Some questions enable users to earn multiple Smiles, some questions enable users to earn one Smile, and some questions have no Smile earning potential. Happi informs users of Smile earning questions via push notifications. Each Smile earning question will be part of a survey with a limited responder requirement. Although there are profile quotas in terms of gender,  nationalities, and age, users who qualify receive the questions on a “first come, first serve” basis.

2.2     You can redeem your accumulated Smiles for any active prize on Happi. The number of Smiles each prize requires is shown clearly on the product detail.

2.3     You will receive the prizes through mobile transmission of a code or voucher within 3-5 days of your redemption.

2.4     After your redemption request, we conduct a compliance check. If we determine your answers or participation are fraudulent, we may withhold compensation and/or terminate or block your account. You will be able to appeal any such determination, but Happi maintains final authority regarding penalty for fraud.

  1. Disclaimers and Exclusion of Liability

3.1     Happi is not responsible for any change to or discontinuance of any product or service offerings on the Site. Participating third party merchants and partners are subject to change at any time without notice.  Nor does Happi make any warranty or representation in respect of any prizes, and Happi does not accept any liability in respect thereof. You must deal directly with the relevant merchant on any issue you may have in respect of any such prize.

3.2     The Site and the Happi App may display advertisements and promotions from third parties or may otherwise provide information about or links to third party products and services. Your dealings or correspondence with, or participation in promotions of, such third parties, and any terms conditions, warranties or representations associated with such dealings or promotions, are solely between you and such third party. Happi is not responsible or liable for any loss or damage of any sort incurred as the result of such dealings or promotions or as the result of the presence of any third party advertisers or third party information on the Site.

3.3     Happi gives no warranty on the accuracy, completeness and timeliness of any content or information on the Site. The Site and the Applications are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, non-infringement or satisfactory quality. These User Conditions (and any ancillary documentation) are not intended to express or imply any warranty that your use of the Applications will be uninterrupted, timely or error-free.

3.4     To the maximum extent permitted under applicable laws, Happi is not liable to you or any third party for any loss, damage, moral distress, cost, expense or inconvenience of any nature which may be suffered or incurred by you arising out of or in connection with your use of the Site and the Happi App. You hereby agree to release and discharge Happi from all claims in relation to the aforesaid loss, damage, moral distress, cost, expense or inconvenience.

3.5     Under no circumstances will Happi be liable for any indirect, punitive, incidental, special or consequential damages that result from, or arise out of the usage of any information stated herein or your use of the Site and the Happi App, and participation in the Happi lucky draws and Random Acts of Happiness.

3.6     You will indemnify Happi against any loss, damage, costs and expenses (including legal costs and disbursements) incurred or suffered by Happi arising from or relating to your misuse of your User account and/or breach of these User Conditions.

3.7     You are responsible to for any and all income tax due your local government for the prizes you receive.

  1. General

4.1     You acknowledge and agree that any comments, suggestions, ideas, feedback or other information provided by you to Happi under any surveys you participate in (“Submissions”) are non-confidential and Happi will be entitled to the unrestricted use and dissemination the Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

4.2     Content on the Site (including text, software, music, sound, logos, trademarks, service marks, photographs, graphics and video) is protected by copyright, trademark, patent, or other proprietary rights and laws, and may not be used in any manner other than as specified herein.

4.3     In the event of any inconsistency between these User Conditions with any other form of publicity collaterals relating to your use of the Applications, these User Conditions will prevail.

4.4     You may terminate your User account and force the deletion of all associated data at any time by giving Happi two (2) days’ prior written notice. Happi may at its sole discretion and without prior notice to you:

(a)     amend any User Conditions, such amendment to take effect immediately upon posting at the Site. You hereby waive any right you may have to receive specific notice of any such amendment;

(b)     immediately terminate your User account if it concludes that you are engaged in fraudulent or illegal activities, or are engaged in activities that may damage its reputation, or you have not provided genuine and valid responses to survey questions.

4.5     Upon termination of your User account, all accumulated Smiles will automatically expire and become null and void. You are not entitled to any compensation from Happi or any other person when the Smiles in your User account have expired.

4.6     These User Conditions are not intended to confer rights to a third party under the Contracts (Rights of Third Parties) Act (Cap. 53B), the provisions of which are hereby expressly excluded.

4.7     These User Conditions are governed by the laws of Singapore. Both you and Happi hereby submit to the exclusive jurisdiction of the courts of Singapore.

4.8     Happi releases the results of survey responses and user generated content including uploaded pictures and mobile activity data to third-parties. This is Happi’s primary source of revenue, and User agrees and consents to the release of their survey, uploaded pictures and videos, and all of the data Happi receives through mobile activity monitoring. Happi does not release any personally identifiable information, such as Users’ names, email addresses or mobile numbers, to any third-party.

4.9   Participation in the HappiRewards panel requires the enablement of a VPN certificate, access to the phone mic, and accessibility permissions to be granted to the Happi App. This enables the aggregation of information about the apps you use, web sites you visit, videos you stream, and terms you search. It also enables Audio Content Recognition which enables us to know the time and location of advertisement detection via the mic on your phone. The app does not record anything and does not listen for anything other than the soundtrack of specific advertisements. You give Happi permission to use, analyse, and sell this data in any manner or form Happi wishes on condition that your name, mobile number, and/or email address are never released to third parties, you may opt-out and request deletion of your data at any time, and you receive the compensation offered through the HappiRewards program, as described when you opt-in for this program.

5.0 ESOMAR Compliance

This section is included to ensure compliance with the ESOMAR code, as defined below. These terms may be redundant with terms stated above. If there is any conflict between the terms stated above and the terms stated in this clause, the terms stated in this clause shall prevail.

Happi is designed for compliance with the ICC/ESOMAR International Code on Market, Opinion and Social Research and Data Analytics. Your use of the Happi application (this “App”, “Happi” or “the Happi App”), is subject to the following terms and conditions (the “Terms”).By accessing, using, or registering to use the App (as defined herein), you agree to follow and be bound by these Terms. IF YOU DO NOT ACCEPT ALL OF THESE TERMS, DO NOT USE THIS APP.

You confirm that you are at least 12 years of age. You further confirm that if you are below 18 years of age, your parent or guardian has confirmed both awareness and consent for you to use this app.

One of the user benefits of Happi is access to promotions aligned with the opinions, preferences and desires you indicate through question responses and prize selections. You understand and confirm consent to receiving promotions, invitations, offers, and additional questions on the App based on your responses to questions and selection of prizes on the App.

The Happi App is a platform for consumer insights and interactions. As such, users receive questions regarding their status, history, intentions, opinions, preferences, and desires on a broad range of consumer, economic, political, religious and lifestyle topics. Happi collects this information on behalf of clients with the intention of selling the information to those clients. These clients may be consumer brands, market research organizations, financial services providers, political groups, employers, media and/or non-profit organizations. This information can be used for analysis by clients or Happi and may form the basis of targeting additional questions or promotions to you. Happi does not release personally identifiable information such as names, email addresses or mobile numbers. Happi does not enable third parties to contact you directly other than through questions and promotions on the app. If you respond to a promotion and choose to offer your personal information to any third party, the terms and conditions of your provision of that information to the third party are between you and the third party.

The Promotions section of Happi is expressly and intentionally devoted to promotions. If you do not wish to receive promotions, do not access the Promotions section of the App. Some of the survey questions may also have promotional intent and may contain hyperlinks that lead to promotional content.

Based on your profile and/or response to questions or selection of prizes, you may receive groups of questions or follow-on questions in the future. Happi enables clients to conduct “daily conversations” with the same individuals and your use of the app indicates your consent to receive these questions.

Your use of the app indicates your consent for your responses, prize selections and profile data to be used in third-party analysis. Happi will delete your account and all your response data upon your written request.

The Happi App is the user interface to a global market research platform. Researchers from all over the world can use the platform to analyze response data from users all over the world. As such, your usage of the app indicates your consent for your profile, response, and prize selection data to be transferred and analyzed anywhere in the world.
